Terms & Conditions



All books are offered for sale subject to availability, as we have several outlets for our products. We do not offer books "on approval". All orders are firm orders.

We are happy to take Credit/Debit card payments over the telephone. Just ring us on 01335 330965 with your requirements and we will try and send you your books on the same or next working day.

All items can be paid for immediately through Sagepay using a credit card or a debit card. Sagepay is very easy to use, secure, completely free and will not incur any additional costs. Your financial information is not shared with us. Once your payment is complete, Sagepay will email you a receipt for the transaction. We despatch your item as soon as payment has cleared and will email you with delivery information.

ALL ITEMS ARE SENT FREE IN THE UK. (£20 minimum order)
However, the following is applicable from 11/7/19

When shipping to the following UK areas or postcodes, parcels over 2kg will carry an extra charge, due to RM and Courier costs. Please contact us for further details before placing an order. We will do our best to send your parcel as economically as we can.

 We can also take payment by Bank Transfer (BACS). Please contact us for further details. Collection in person is also welcome from our address.  You can also collect from our trade stand at any of the events we attend by prior arrangement.
Please note: as from 19/3/18 we do not accept payment by cheque, due to the processing costs and the very limited demand for this method of paying.
Please note: as from 8/5/22 we do not accept payments by PayPal due to increasing administartive and processing costs. 
RESERVING BOOKS
We are happy to reserve books for you on the understanding that you have a firm commitment to buying that book in the future. However, in general, we are unable to reserve books for more than 48 hours, unless you have spoken to us personally and have come to an agreement on another basis. 
We reserve the right to cancel orders at any time.
Postage and Shipping
Some items posted will require a signature on delivery, as we use Royal Mail signed For Service on some items. Other items may be sent Royal Mail 24 or 48. We also use Courier services such as DPD Local for packages weighing over 2kgs and these will require a signature on receipt.  Postage and Packaging are provided to our customers free of charge. Items are packed with great care. However, in the unlikely event that an item is damaged during transit, please contact us within 2 hours of receiving the item(s). A receipt with full details of your purchase will be included in your parcel, which may be useful for insurance purposes. Any request to mail any items to a third party is entirely at your own risk. It is only acceptable on the condition that Linda Tinker Railway Books are not in any way responsible for any loss or damage caused at any stage or transit and are not in any way to be involved in any investigation into such loss or damage.

Books Not Delivered?
Occasionally, books are unable to be delivered, usually because the buyer is out, and no safe place has been designated for the postal worker or courier to leave the parcel. In this case the parcel will be taken back to the appropriate depot and a card left with instructions stating how you can get hold of it. If you do not collect the parcel or make arrangements for delivery, it should be returned to us eventually. In this case, you have a choice. 1) to have the books sent again, in which case we will charge you for postage at cost (both UK and International), or 2) to cancel the transaction, in which case we would refund the cost of the books only.

Returns Policy
As Sellers committed to offering reliable, competent and friendly service, all our items are offered in good faith and described to the best of our knowledge.To ensure clients enjoy risk free shopping, we operate a 100% purchase price money back guarantee if you are unhappy with your purchase. Postage costs cannot be refunded and the buyer must pay return postage costs. You may return an item within 14 days of receiving your goods; prior notice should be given by email. Provided items are returned in good, undamaged condition in the original packaging, the full purchase price will be refunded. Should returned items be found to be damaged, a percentage of the purchase price will be withheld. No returns will be accepted after a period of 14 days in the buyer’s possession. All items should be returned to the above address.
Please note: you should inform us immediately of damaged goods.

Linda Tinker Railway Books is the data controller and we are responsible for your personal data (referred to as “we”, “us” or “our” in this policy).

Sensitive Data 
We do not collect any Sensitive Data about you. Sensitive data refers to data that includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data. We do not collect any information about criminal convictions and offences.


2. HOW WE USE YOUR PERSONAL DATA 
We will only use your personal data when legally permitted. The uses of your personal data are: 
Where we need to perform the contract between us.
Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
Where we need to comply with a legal or regulatory obligation.

Generally, we do not rely on consent as a legal ground for processing your personal data, other than in relation to sending marketing communications to you via email. When you place an order through our website (www.lindatinkerrailwaybooks.co.uk), you are asked to tick a box indicating that you agree with our Terms & Conditions. These are set out on out “Terms & Conditions” page, and include this Privacy Policy.

When you place a verbal order by telephone, by allowing us to enter your data (name, address, telephone number) onto our ordering system, you are agreeing with our Terms & Conditions. These are set out on out “Terms & Conditions” page, and include this Privacy Policy.

Credit/debit card numbers given to us by telephone, are not retained by us once the order has been processed. When an order has been placed through the website, credit card details are not revealed to us.

Paper invoices are kept for six years, for HMRC accounting purposes, and are then shredded. 

Similarly, customer data (name, address, phone number and email) are kept on our website for six years, and then deleted, if no order has been received for six years. Deletions are made at the end of the following January.

If you ask for a book to be sent to another person (eg as a gift), we do not have to get the gift recipient’s consent. No consent is necessary for performance of a contract: We would need to process the gift recipient’s data in order to fulfil our side of the contract with the purchaser.


If you sell us books and a previous owner’s name or other personal details are inscribed in the book, we will delete or redact those details to the best of our ability.

3. MARKETING COMMUNICATIONS

You will receive marketing communications from us if you have: 
requested information from us or purchased goods or services from us; or
if you provided us with your details and ticked the box at the point of entry (on our website) of your details for us to send you marketing communications; and in each case, you have not opted out of receiving that marketing.

We will get your express opt-in consent before we share your personal data with any third party for marketing purposes.

You can ask us or third parties to stop sending you marketing messages at any time by emailing us at lindatinkerrailwaybooks@gmail.com at any time. 

Where you opt out of receiving our marketing communications, this will not apply to personal data provided to us as a result of a product/service purchase, product/service experience or other transactions.


4. DISCLOSURES OF YOUR PERSONAL DATA 

We may have to share your personal data with the parties set out below for the purposes set out in the table in paragraph 2 above: 
Service providers who provide IT and system administration services.
Professional advisers including lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance and accounting services.
HM Revenue & Customs, regulators and other authorities based in the United Kingdom and other relevant jurisdictions who require reporting of processing activities in certain circumstances.


We require all third parties to whom we transfer your data to respect the security of your personal data and to treat it in accordance with the law. We only allow such third parties to process your personal data for specified purposes and in accordance with our instructions. 


5. DATA SECURITY 

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know such data. They will only process your personal data on our instructions and they are subject to a duty of confidentiality. 

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

Electronic details are kept on two Apple Mac machines only used by our staff. Both are password protected, as is the administration page of the website which holds customer data. The website and e-commerce system are also protected by internet anti-virus software as used and recommended by Apple. 



6. DATA RETENTION 

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. 


To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.


By law we have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years after they cease being customers for tax purposes. 

In some circumstances you can ask us to delete your data: see below for further information. 

In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.



We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.



We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
